These Terms of Service ("Terms") govern your use of Profynix Hosting services. By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you may not access or use our services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.
Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your account credentials
- You must be at least 18 years old or have parental consent to use our services
- One person or entity may not maintain multiple accounts without prior approval
- You must notify us immediately of any unauthorized use of your account
Service Usage
- Services are provided on a shared infrastructure unless otherwise specified
- You may not use our services for illegal activities or spam
- Resource usage must comply with our fair usage policy
- We reserve the right to suspend accounts that violate our terms
- Backup of your data is your responsibility unless backup services are purchased
Billing and Payments
- All fees are due in advance and are non-refundable except as stated in our refund policy
- Prices are subject to change with 30 days notice
- Late payments may result in service suspension
- You are responsible for all taxes related to your use of our services
- Refunds are available within 30 days for hosting services only
Acceptable Use Policy
- No illegal content, spam, or malicious software
- No excessive resource consumption that affects other users
- No copyright infringement or unauthorized distribution of content
- No harassment, threats, or abusive behavior
- Compliance with all applicable laws and regulations
Service Limitations
- We provide services "as is" without warranties of any kind
- We do not guarantee 100% uptime, though we strive for 99.9% availability
- We are not liable for data loss, though we maintain regular backups
- Our liability is limited to the amount paid for services in the preceding 12 months
- We reserve the right to modify or discontinue services with notice
Service Level Agreement
Uptime Guarantee
We guarantee 99.9% uptime for our hosting services. If we fail to meet this guarantee, you may be eligible for service credits as outlined in our SLA.
Support Response
We aim to respond to support tickets within 24 hours for standard support and within 4 hours for priority support customers.
Termination
Either party may terminate this agreement at any time. You may cancel your services through your account dashboard or by contacting our support team.
We may suspend or terminate your services immediately if you violate these Terms or engage in activities that harm our infrastructure or other customers.
Dispute Resolution
Any disputes arising from these Terms or your use of our services will be resolved through binding arbitration in accordance with the laws of Nigeria.
Before initiating formal dispute resolution, we encourage you to contact our support team to resolve any issues amicably.
